Recently, the Yiwu People's Court of Zhejiang Province issued a judgment in the case brought by Hubei Shendi Huifeng Technology Co., Ltd. (hereinafter referred to as “Shendi Huifeng”), a subsidiary of Shendi Group, against defendants including Changsha Jianling Department Store and Yiwu Huanjin Trading Co., Ltd., regarding disputes over infringement of copyright in reproduction, distribution, and online transmission rights, as well as unfair competition. Shendi Huifeng emerged victorious in the lawsuit. This marks a significant breakthrough and victory for Shendi Group’s special enforcement campaign aimed at combating unfair competition involving its Dan Sheng Yuan® eggshell fruit and vegetable cleaner product, which is set to launch at the beginning of 2025!
Recently, the Yiwu People's Court of Zhejiang Province issued a judgment in the case brought by Hubei Shendi Huifeng Technology Co., Ltd. (hereinafter referred to as “Shendi Huifeng”), a subsidiary of Shendi Group, against defendants including Changsha Jianling Department Store and Yiwu Huanjin Trading Co., Ltd., concerning disputes over infringement of copyright in reproduction, distribution, and online transmission rights, as well as unfair competition. After trial and investigation, the court finds that:
1. Infringement of the rights to publish works and the right to transmit them via information networks is established.
“The defendants, Changsha Jianleng Department Store and Yiwu Huanjin Trading Co., Ltd., without the plaintiff’s permission, displayed and sold products featuring the plaintiff’s copyrighted artwork on their online stores. Therefore, they should be deemed to have infringed upon the plaintiff’s rights of distribution and right of information network dissemination with respect to the works in question, and thus bear civil liability to cease the infringement and compensate for the losses incurred.”
2. The act of unfair competition is established.
“The defendants, Changsha Jianleng Department Store and Yiwu Huanjin Trading Co., Ltd., in the product detail pages of their online stores, posted images claiming ‘product packaging upgrade,’ labeled the plaintiff’s products as outdated models, and labeled the allegedly infringing products as new models. They further stated that the current products are in a transitional phase and that both old and new packaging will be shipped randomly. The aforementioned promotional activities by the two defendants are likely to mislead ordinary consumers into believing that the allegedly infringing products originate from or are affiliated with the plaintiff, thus constituting false advertising. Therefore, the actions of the two defendants constitute unfair competition and they should bear civil liability for ceasing the infringement and compensating for the losses incurred.”
Based on the above findings, the court ruled that our company’s claim is well-founded and... Judgment rendered (Case No. (2025) Zhejiang 0782 Min Chu 1097; Case No. (2024) Zhejiang 0782 Min Su Qian Tiao 31436; Case No. (2024) Shanghai 0105 Min Chu 29665) , ordering the defendants Changsha Jianleng Department Store and Urumqi Huanjin Trading Co., Ltd., among others, to... Immediately cease the infringing activities and pay compensation for economic losses totaling 100,000 yuan, thereby firmly safeguarding Shendi Huifeng’s legitimate rights and interests as well as its brand reputation.
